Tow hearings in Brazos County

A person whose vehicle was towed without consent in College Station or Bryan can ask a Brazos County justice court for a hearing on whether the tow had probable cause.

Asking for the hearing

The written request goes to a justice court in Brazos County before the 14th day after the tow, not counting weekends and legal holidays. The county's fee table lists $54 for a tow hearing. The court holds the hearing within 21 days of the request.

What the court decides and may award

The court decides whether there was probable cause for the tow and whether the charges were above the allowed amounts. It may award court costs and attorney's fees to the prevailing party, the cost of sign photos, the amount of any overcharge, and reimbursement of towing and storage fees.

Appeals

Either side may appeal to county court, where the case is tried again under justice-court rules and no appeal bond may be required. In 2025 the Tenth Court of Appeals applied those rules to allow an oral request for attorney's fees in such an appeal.
