College Station's game-day tips: what gets towed and whom to call
The City's blog lists parking violations that are towable on game days, such as facing traffic, blocking hydrants or intersections, parking too close to stop signs and parking in no-parking zones. It says to call the Police Department's non-emergency number, 979-764-3600, if your vehicle has been towed.
Appeals court: no written pleading needed to ask for attorney's fees in a tow-hearing appeal
In an appeal from a Brazos County tow hearing about a College Station lot, the Tenth Court of Appeals held that justice-court rules govern the county-court retrial, so the vehicle owner could request attorney's fees orally at trial. It cut the award to $750, the amount the evidence supported.
Appeals court upheld a no-probable-cause finding where the lot fee was paid before the tow
The Tenth Court of Appeals affirmed a Brazos County judgment that a car was authorized to park in a $5 cash lot in College Station because the fee for its space had been paid before the tow, so there was no probable cause to tow it. The owner had been charged $299.06.
Two more appeals about the same College Station pay lot end the same way
The Tenth Court of Appeals affirmed two county-court judgments that cars were towed without probable cause from a College Station cash pay lot after the owners had paid. In one, the driver left for about five minutes to get cash, paid, and was towed about an hour later.
