Is my car being sold? Lien sales and auctions in the Rio Grande Valley

If a tow company or storage lot keeps a car and the bill is not paid, the car can be sold after the notices and waiting periods the law sets. The notice you get tells you which rules apply and how much time you have.

How a towed car can be sold

  1. Most towed cars in the Valley are held at private, state-licensed storage lots; none of the six cities posts a public impound lot or auction calendar that we found. A lot's sale follows the Vehicle Storage Facility Act notices.

  2. In McAllen, rotation-list wrecker companies must report abandoned vehicles from rotation tows to the McAllen Police Department on a City form, under Transportation Code § 683.031. The City Code says the report includes a $5.00 fee; § 683.031 itself sets a $10 fee.

  3. When police take an abandoned vehicle into custody, they must mail notice within 10 days; the owner has 20 days from the notice to claim it before a public auction.
